Hi Theclassichaul1,

You can get quite a bit of good advice here but, if you're looking for legal advice - you need to contact a professional.  See if your area has a local Small Business Development Center (SBDC) - they offer free advisory services to aspiring entrepreneurs and small business owners and help get you going in the right direction.

Just some general stuff - is your plan to form a business or is this just a hobby - regardless there are tax considerations down the road to consider if you plan on using a Transaction Processing Service such as Square.   You can setup a Square Account if you don't have a license and/or permit however, at a minimum you will need to provide a Social Security Number, home address, attach a bank account and of course be age 18 or older.

Now here's some more details to consider:

Whether or not you need a business license to sell items depends on various factors, including your location, the nature of the items you are selling, and the scale of your sales. Here are some thoughts, note, it's important to check with your local government or a legal professional to get specific advice for your situation:

* Location: The requirements for a business license can vary significantly from one place to another. Local, state, and national regulations may apply, so it's crucial to determine the specific rules in your area.

* Nature of Items: The type of items you are selling can also impact whether you need a license. Some items may be subject to specific regulations or licensing requirements, such as alcohol, firearms, food, or pharmaceuticals.

* Scale of Sales: Small-scale, occasional sales may not require a business license in some areas. However, if you plan to sell items regularly, especially as a primary source of income, you are more likely to need a license.

* Online vs. In-Person Sales: The method of selling can also affect licensing requirements. Online businesses often need to consider not only their physical location but also where their customers are located.

* Home-Based Businesses: If you are operating a business from your home, you may need additional permits or approvals, depending on your local zoning regulations.

* Taxes: Even if you don't need a specific business license, you may still need to register for tax purposes. This often includes obtaining a sales tax permit or employer identification number (EIN) from the IRS in the United States.

* Industry Regulations: Certain industries, such as healthcare, construction, and transportation, have strict licensing requirements and may require specialized permits or certifications.

*** To determine whether you need a business license, you should:

1. Contact Your Local Government: Reach out to your city or county government, or the relevant regulatory agency in your area, to inquire about the specific requirements for your business.

2. Consult with Legal or Business Professionals: It's advisable to consult with an attorney or a certified public accountant (CPA) who specializes in business matters. They can provide guidance tailored to your situation.

3. Research Online: Many government websites provide information on business licensing requirements. Look for resources from your local government and relevant industry-specific organizations.

Failing to obtain the necessary licenses and permits for your business can lead to legal issues and fines. Therefore, it's crucial to understand and comply with the regulations applicable to your specific business and location.

Super Seller

@theclassichaul1 ;

Along with the detailed reply by @JK_Fiber_Art , I would add that you do not need a Business License to use Square.  You can use it for personal reasons like to take payments for a garage sale etc but you need to be verified through Square.  Now if you are trying to start an actual Business I would suggest checking with your local and State regulations for the type of business you would be starting and wait till you have the correct documentation from them to open a Square  for your business.  If you create a Personal account for like Garage Sales, and want to switch it to a Business.... you can not do that from what I know.  I could be wrong, as things are always changing.
